This Article discusses BLAs as tools of global labor migration governance, with a specific focus on gender. Drawing on our global database of 582 bilateral labor migration agreements, we investigate the extent to which these governing instruments connect and align with relevant international normative frameworks, in particular the extent to which they represent gains, gaps or gaffs in terms of gender equality and the human and labor rights protection of women migrants. In the context of the Global Compact for Safe, (...) Orderly and Regular Migration, which stresses a gender-responsive approach to migration governance as one of its guiding principles, we ask: Do the BLAs which are increasingly being used as instruments to govern labor migration contribute toward sustainable gender equality, decent work and reduced inequalities for women and gender-diverse migrants? Hukuk düzeninin kişiye bahşettiği haklar, iktisadi değer taşıması yönünden “malvarlığı hakkı” ve “şahıs varlığı hakkı” şeklinde esaslı bir ayrıma tabi tutularak incelenmektedir. İktisadi değer taşıyor olması yönüyle şahıs varlığı haklarından farklılaşan malvarlığı hakları, herkese karşı ileri sürülebiliyor olması durumunda “mutlak”, yalnızca borçlu namındaki yükümlüye karşı ileri sürülebiliyor olması halinde ise “nisbî” şeklinde nitelenir. Mutlak mamelek hakları somut bir kütleye sahip olan (cismanî) bir konu üzerine kuruluysa aynî hak adını alır. Aynî haklar, nisbî özellik taşıyan ve dolayısıyla belirli bir şahsın edimi (...) sayesinde ve ancak onun aracılığıyla kullanılan alacak haklarıyla birlikte malvarlığının iki önemli bileşenini oluşturur. Tarihsel süreçte bu iki hak türünü birbirine yaklaştırmaya yönelik çeşitli teşebbüslerde bulunulmuşsa da bu haklar gerek mahiyet gerek hüküm itibariyle farklı kabul edilmeye devam etmiştir. Söz konusu farklılık, hakkın konusu üzerindeki hakimiyetin şekli yani doğrudan veya dolaylı olması bakımından, bahse konu hakların eşyanın aidiyetine etkisi açısından, hakkın mutlak veya nisbî olması cihetinden, sürekli olup olmama yönünden ve makalede etraflıca ele alınacağı üzere öncelik/üstünlük itibariyle ortaya çıkmaktadır. Kara Avrupası hukuk sistemine ait olan bu kavramsal kurgu ve terimlerin muadillerine veya benzerlerine İslam hukuk doktrini içerisinde de rastlanmaktadır. Bu kapsamda fıkıh literatüründe malvarlığı haklarının tümüne şamil olacak şekilde “milk” terimi kullanılmış, hakkın konu edindiği varlığın niteliğine göre de “milkü’l-ayn”, “milkü’l-menfaa”, “milkü’d-deyn”, “milkü’l-habs ve’l-yed” gibi terimler geliştirilmiştir. İnsanlar arasındaki hukuki menfaatlerin karşı karşıya geldiği bazı durumlarda bu iki hak türü arasında tercih yapmak gerekebilmektedir. Bu tarz bir tercih durumunda aynî haklara, ihtiva ettiği yetkiler dikkate alınarak şahsî haklar karşısında bir tür öncelik tanınmıştır. Söz konusu önceliğin en belirgin şekilde görüldüğü yerlerden biri de kiraya verilen malın kira akdi devam ettiği sırada üçüncü kişilere devredilmesidir. Bu noktada İslam hukukunda kira akdinin kişiye kazandırdığı yetkiler Kara Avrupası hukuk sistemine göre farklılık arz eder. Makalede kiracının bu hakkının İslam hukukuna göre -Kara Avrupası hukuk sisteminden farklı olarak- aynî nitelikte kabul edildiği savunulmaktadır. Bunu temellendirmek için kiralanan malın kira müddeti içerisinde üçüncü şahıslara satılması, kiralanması veya gasp gibi haksız fiil şeklinde yorumlanabilecek yollarla intikal etmesi halinde fıkıh doktrininde kiracıya tanınan yetkiler incelenmiş İslam hukukunun bu hususlardaki özgün yaklaşımı klasik ve modern fıkıh eserleri dikkate alınarak, Türk hukukuyla da kıyaslamalar yapmak suretiyle ifade edilmiştir. Konvansiyonel finans kurumları bu ihtiyaçlarının büyük kısmını repo-ters repo işlemleri ile karşılarken katılım finans kurumları ise faiz şüphesi nedeniyle repo-ters repo katılım bankacılığı ilkelerine uymadığı için bu ihtiyaçları karşılama konusunda problemler yaşamaktadır. Bu durum konvansiyonel finans kurumları ile rekabet halindeki katılım finans kurumları aleyhine işlemektedir. Bu makale repo işlemini ana hatlarıyla açıklayıp fıkhi boyutunu izah ettikten sonra Malezya’daki geri alım vaadi ile satım, Türkiye’deki (...) geri alım vaadi ile satım, organize teverruk, menkul kıymet rehinli karz sözleşmesi ve puantaj sistemi ile tekaruz anlaşması gibi halihazırda İslam dünyasında katılım finans kurumlarının repoya alternatif olarak uyguladıkları işlemleri ele almaktadır. Öte yandan bu çalışma kira sertifikalarının geri alım vaadi ile satımı, yatırım fonları, kira sertifikalarının alım satımı ile teverruk işlemi için katılım finans ilkelerine uygun bir pazar kurulması ve devlet destekli karz-ı hasen fonlarının kurulması gibi katılım finans kurumları adına repoya alternatif olarak düşünülen öneriler üzerinde yoğunlaşmaktadır. Quranic recitations have attracted great attention from scholars throughout the ages. The recording of Quranic recitations, whether in special works, tafsir or hadith works, began in the early periods of Islamic history. This study aims to introduce Ibn al-Yazidi, Abu Abdurrahman al-Yazidi (d. 237 AH) and to examine his approach to presenting and guiding Quranic recitations in his book “Gharib Al-Qur’an and Tafsir”. The Yazidi family is famous in the field of Quranic recitations. At the forefront comes Abu Muhammad Yahya (...) bin al-Mubarak (d. 202 AH), the father of Abu Abdul Rahman Abdullah bin Yahya, the author of the book under study. Abu Muhammad has a special narration and interpretations in Quranic recitations. Abu Abdul Rahman narrated the recitation of Abu Amr bin Al-Ala (d. 145 AH) from his father Yahya and acquired Arabic knowledge from Farra (d. 207 AH). Ibn al-Yazidi wrote the book “Gharib Al-Qur’an and tefsir”, which is in the middle ranks among its peers, including the gharibul-Qur'an and the languages of the Quran. He revealed his preferences in recitations and explained their meanings and the differences between them. Ibn al-Yazidi also wrote his book before many of the famous books in Bayan al-Gharib and al-Kira'at. Ibn al-Yazidi, who acquired the recitation from his Yazidi father Yahya bin al-Mubarak (d. 202 AH), the owner of the famous recitation, did not stick to a single recitation in his book. Since the readings he confirmed or selected in his book are a mixture of mutawatir, famous and shaz readings, as we will see throughout our study, he did not mention this classification, which came late for his time. Similarly, regarding the strange words in Ibn al-Yazidi's book Gharib Al-Qur’an and tefsir, we see that sometimes he mentions some words in a different order in the verse or verses. Sometimes he presented the Qur'anic recitation with a verse that is not in place in the Qur'an. Because while explaining the strange words, he relied on interpreting the Qur'an with the Qur'an, so he mentioned another verse by saying "from him" or "from that" and presented the recitation in the verse. Ibn al-Yazidi was also interested in the languages mentioned in the Qur'an and their status in explaining, defining and guiding the Qur'anic recitations. Thus, Ibn al-Yazidi presented various readings in many places of the book, and became a reference that was used by Mekki ibn Abi Talib (d. 437 AH), Ibn al-Jawzi (d. 597 AH) and other writers in tafsir, garib al-Qur'an and readings. In the study, a scanning approach was followed to list the words mentioned by Ibn al-Yazidi in one or more of his readings, and a historical descriptive approach was followed to mention the life of Abu Abdul Rahman and to explain the importance of his book and its scientific value in the field of garib al-Qur'an and Qur'an readings. Later, in his work titled "Gharib Al-Qur’an and its Tafsir", an analytical approach was followed to explain Ibn al-Yazidi's sources and his approach to presenting and directing the readings. The study consists of an introduction, two sections, a conclusion and a bibliography. The introduction section includes the importance and methodology of the study. In the first part, Ibn al-Yazidi's introduction and the introduction of his book called Gharib Al-Qur’an and its Tafsir are given. Muhyiddîn el-Kâfiyecî (öl. 879/1474), on beşinci yüzyıl Saruhanoğulları, Osmanlı ve Memlüklü alimlerindendir. Yüzden çok eser yazmıştır. Makale Kâfiyeci’nin hayatı ve eserlerini araştırır. Yazdığı eserler, onun, Arap dili, Arap grameri, belagat, tarih metodolojisi, hadis ve usulü, tefsir ve usulü, fıkıh ve usulü, kelâm, tasavvuf, dil felsefesi, semantik, metafizik meseleler, geometri, optik ve astronomi gibi konularda uzmanlaştığını göstermektedir. Kâfiyeci en önemli eserlerini Arap dili ve mantık sahalarında yazmıştır. Eserleri içerisinde yaptığı linguistik çözümlemeler, onun yetkin bir dil alimi olduğunu göstermektedir. Kâfiyeci eserlerini yazarken (...) linguistik, mantıki, ilmi ve felsefi bir yöntem kullanmıştır. Araştırmada, Kâfiyeci’nin, hayatı boyunca en az yüz on iki eser yazdığı tespit edilmiştir. Comment témoigner d’une espérance religieuse dans le droit contemporain ? Par l’obéissance et l’humilité de l’inculturation, ou par l’objection et la résistance propre au signe de contradiction ? Si les périodes barbares du XXe siècle ont relancé l’analyse théologique de la tension entre ces deux voies, qu’en est-il aujourd’hui des contextes apparemment pacifiés de nos droits démocratiques ? Si le moment juridique y colonise progressivement la société, c’est au nom de sa nature de « droit commun » qu’il estime acquérir (...) de sa prétention croissante à la « neutralité ». À cet égard, la prise de parole religieuse dans l’espace public est aujourd’hui vivement débattue. Il serait cependant erroné de n’y viser que le seul moment de l’élaboration formelle de la loi. Cette prise de parole peut aussi viser les modalités d’application et de mise en contexte du droit. Cet article entend montrer l’importance de ce nouveau moment pour une prise de parole religieuse, entendue comme une troisième voie : celle de l’attestation évangélique au cœur de la pratique du droit. This book explains why Tocqueville saw the central task of modern statesmanship as combating 'individualism,' a type of civic apathy that he thought capable of robbing modern citizens of human virtue and issuing in a historically unprecedented form of despotism. It looks in depth at the mechanisms he proposed for avoiding the perils and securing the promise of democracy in his own day, and discusses how Tocqueville's insights might be applied in our own time.

Upshot: Eigenform is a precondition for distinction and distinction is a precondition for eigenform. While my target article discussed eigenform and reflexivity, it could just as well have discussed distinctions and the emergence of distinctions. This theme was implicit in many of the comments. We make this circularity explicit for the sake of a deeper understanding.

Purpose. The purpose of the study lies in critical reconstruction of Thomas Hobbes’s social contract theory as an important principle not only of modern political anthropology, but also of modern and postmodern social projects. As well as, in the unfolding of the fundamentally important both for the newest social-philosophical and philosophical-anthropological discourses of the thesis that each individual is the origin of both personal and institutional freedom and justice, making the contract first of all with himself, with his desires and (...) sorrows and then with other people and the state. Theoretical basis. The principle of social contract offered by Hobbes became a new social, methodologically significant and relevant principle of regulation of activity, which indicates essential for the modern political philosophy and the philosophy of law transition from teleological to legal ideas of justice. For an in-depth study of the philosophical and anthropological aspects of Hobbes’s contractualism, we used the historical-comparative and contextualization method, as well as the works of leading native and foreign researchers of Hobbes, who uphold the provisions on the organic affiliation of fundamental socio-philosophical and philosophical-anthropological questions about the nature of man, the relation of coercion, freedom and justice with the discourse of social contract. Originality. On the basis of a consistent analysis of the anthropological component of Hobbes’s theory of social contract, an in-depth understanding of modern contractualism and contemporary discussions in the field of its existential and anthropological component is offered, as well as the thesis that political anthropology is the core of the philosophical anthropology because it makes possible the methodologically important understanding of the basic problems of human existence – the interaction of justice and freedom, self-interest and public good, as well as it quite clearly outlines the ways to overcome the dilemmas of liberalism and communitarianism, individualism and holism. Conclusions. Political anthropology of T. Hobbes constructed in the context of a modern social project, justified the issue of interaction between freedom and justice, which is fundamentally important to nowadays, through the search for such a way of social relations, in which an individual, being in the realm of social existence, would seek to limit his own selfishness and freedom for the sake of the common will of the majority. Thanks to Hobbes, the idea of external humility in disobedience to the inner, of freedom of conscience as a "human and citizen", of an understanding of individual independence, which is not just a permissible but accepted by state power, has been acquired with exceptional theoretical and practical meaning. Thanks to Hobbes’s works, the essence was revealed by the relationship between the cooperative and the conflicted vision of man. (shrink)
